“What And Why We Celebrate Today”: In Washington, D.C., Reminders Of America’s Dark History Of Segregation

We are in the waning hours of African American History month — the time set aside each year to reflect on black struggles and sacrifices to achieve America’s promise.

My recognition of African American contributions began in the 1940s with annual celebrations of Negro History Week at Stevens Elementary School in my West End/Foggy Bottom community. Our nation’s capital is also where I experienced first-hand America’s shame.

Liberty Baptist Sunday school taught me the Ten Commandments. Civil authority in the city taught me the others.

Among them: Thou shalt not attend Grant Elementary School on G Street NW, which was for white children only. Thou shalt not attempt to enter the Circle Theater at 21st and Pennsylvania Avenue NW, where only whites were allowed. Thou shalt never think about dining downtown.

Thou can purchase sodas and sandwiches at the drugstore at the corner of 25th and Pennsylvania Avenue NW. But thou shalt not sit and eat. Thou must stand at the end of the counter and wait patiently to be recognized.

Ah, Washington of my youth — a place and time when skin color determined where you lived, attended school, worshiped and worked, and how much you got paid.

I learned that lesson as a teenager looking for part-time work. Pick up the Jan. 3, 1960, edition of The Post and what do you see?:

“BOYS-WHITE Age 14 to 18. To assist Route manager full or part-time. Must be neat in appearance. Apply 1346 Conn. Ave. NW.”

“DRIVERS (TRUCK) Colored, for trash routes, over 25 years of age; paid vacation, year-around work; must have excellent driving record. Apply . . . 1601 W St., N.E.”

“STUDENTS Boys, white, 14 yrs. and over, jobs immediately available. Apply . . . 724 9th St., N.W.”

Simply stated: If you’re black, git back.

In our anger and humiliation we turned to Negro History Week to celebrate black achievers such as Mary McLeod Bethune, George Washington Carver, Frederick Douglass, Charles R. Drew, Matthew Henson, Ralph Bunche and Joe Louis.

Even as we annually paid homage to our black champions and their victories, we remained in the vise grip of segregation.

From a 1948 “Segregation in Washington” report: “Only 30 percent of the residents of the District of Columbia are Negroes,” the report said. “But Negroes have 70 per cent of the slum residents.”

It was no accident, said Wendell E. Pritchett of the University of Pennsylvania Law School, who explained in a 2005 paper how the system functioned.

“This system of segregation was imposed by powerful interests, particularly those in the real estate sector,” he wrote. “The 1948 Washington Real Estate Board Code of Ethics stated that ‘no property in a white section should ever be sold, rented, advertised or offered to colored people.’ ”

“Segregation was maintained by residents’ associations, which had organized into the powerful Federation of Citizens’ Associations that policed the city’s racial borders,” Pritchett noted, adding: “The result was that blacks were forced to pay higher rents in the limited areas to which they had access, and in these areas housing was significantly inferior.”

Pritchett continued: “The damage caused by segregation was exacerbated, the [1948] report concluded, by the on-going urban renewal program that was clearing many formerly poor black areas for middle-class housing restricted to whites. Of the 30,000 new units built during the 1940s, just 200 were available to blacks.”

Today’s millennials are not pioneers. Gentrification of the District got underway decades ago.

Why do some of us celebrate African American History Month with moist eyes?

Return in time to the corner of Pennsylvania Avenue and 3rd Street NW in the 1830s. See that brick federal building with its hipped roof, dormer windows and stone keystones? It’s called the St. Charles Hotel.

It has a special feature.

In the basement are six 30-foot-long arched cells, with heavy iron doors and iron rings embedded on the walls. It’s a slave pen.

Look down at the sidewalk. See the recessed grills to provide light and ventilation for the confined slaves.

St. Charles is where the Southern planters stayed when they came to Washington to sell their slave property.

A few blocks away, at the southwestern corner of 4th and G streets NW, stands the Washington jail. That’s where runaway slaves were confined. Until emancipation, all slaves were required to obey the curfew law. Getting found on the streets of Washington after sundown without written permission from the master was a one-way ticket to jail. The owner had to be notified to appear before the warden to identify their slaves and pay a fine to reclaim them.

From being chained in the basement to abolition, marches, legal assaults against injustice, the White House, the mayor’s suite, the halls of Congress, the faculty lounge, the judge’s chambers, the corporate boardroom, the pulpit, the Officers Club and the editor’s desk.

That’s what and why we celebrate today.

“Same Monstrous Reasoning That Defended Slavery”: The U.S. ‘Right’ To Own Guns Came With The ‘Right’ To Own Slaves

For most of the last two centuries, Europeans have been puzzling over their American cousins’ totemic obsession with guns and their passion for concealed weapons. And back in the decades before the American Civil War, several British visitors to American shores thought they’d discerned an important connection: people who owned slaves or lived among them wanted to carry guns to keep the blacks intimidated and docile, but often shot each other, too.

In 1842, the novelist Charles Dickens, on a book tour of the United States, saw a link between the sheer savagery of slave ownership and what he called the cowardly practice of carrying pistols or daggers or both. The author of Oliver Twist listened with a mixture of horror and contempt as Americans defended their utterly indefensible “rights” to tote guns and carry Bowie knives, right along with their “right” to own other human beings who could be shackled, whipped, raped, and mutilated at will.

As damning evidence of the way slaves were treated, in his American Notes Dickens published texts from scores of advertisement for the capture of runaways. Often these public notices described the wanted men and women by their scars. One especially memorable example:

“Ran away, a negro woman and two children. A few days before she went off, I burnt her with a hot iron, on the left side of her face. I tried to make the letter M.”

Dickens also compiled a list of several shooting incidents, not all of them in the South: a county councilman blown away in the council chamber of Brown County, Wisconsin; a fatal shootout in the street in St. Louis; the murder of Missouri’s governor; two 13-year-old boys defending their “honor” by dueling with long rifles, and other examples.

What could one expect, he asked, of those who “learn to write with pens of red-hot iron on the human face” but that they carry guns and daggers to use on each other.  “These are the weapons of Freedom,” Dickens wrote with brutal irony.  “With sharp points and edges such as these, Liberty in America hews and hacks her slaves; or, failing that pursuit, her sons devote themselves to a better use, and turn them on each other.”

When Dickens was writing in the 1840s, remember, keeping Negro slaves was defended as a Constitutional right with the same vehemence that we hear today when it comes to keeping and bearing arms, and perhaps with more foundation. The original U.S. Constitution was built on an explicit compromise (Article 1, Section 2, Paragraph 3) that allowed slave-holding states to count human chattel, described as “other persons,” as three-fifths of a human being for purposes of taxation and state representation in the House, but allowed them no rights as human persons whatsoever.

The Second Amendment, adopted a couple of years later as part of the Bill of Rights (of free white people), was essentially written to protect the interests of Southerners in the states that formed militias—often known as “slave patrols”—to crush any attempt at what was called, in those days, a “servile insurrection.” That’s why the full text of the Second Amendment reads:

“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

To keep slaves in slavery, you needed militias and they needed to be armed. Such is the fundamental “right” assured by the Second Amendment.

Dickens, who saw a lot that he disliked about America, but disliked slavery and the irrational and immoral thinking behind it the most, wrote quite correctly that there was a substantial, stubborn class of people “who doggedly deny the horrors of the system, in the teeth of such a mass of evidence as never was brought to bear on any other subject.”

A few years later, after the messianic abolitionist John Brown tried and failed to start a slave uprising by attacking the Federal arsenal at Harper’s Ferry in 1859, Southern paranoia reached new heights, and so did gun sales.

“I do not exaggerate in designating the present state of affairs in the Southern country as a reign of terror,” wrote British Consul Robert Bunch in Charleston, South Carolina, the epicenter of secession and slavery. “Persons are torn away from their residences and pursuits, sometimes ‘tarred and feathered,’ ‘ridden upon rails,’ or cruelly whipped; letters are opened at the post offices, discussion upon slavery is entirely prohibited under penalty of expulsion, with or without violence, from the country.”

Bunch, the central figure in my recent book Our Man in Charleston: Britain’s Secret Agent in the Civil War Southnoted that “on the part of individuals the sense of danger is evinced by the purchase of fire-arms, especially revolver pistols, of which very large numbers have been sold during the last month.”

In 1861, the great British war correspondent William Howard Russell, traveling through the South in the early days of the Civil War, was as bemused as he was appalled by what passed for “dueling” in Mississippi, which amounted to little more than random, often drunken murders. One resident told him “without the smallest animus, and in the most natural way in the world … tale after tale of blood, and recounted terrible tragedies enacted outside bars of hotels and in the public streets close beside us.”

It is a grim irony, therefore, that the legal precedents set in the antebellum South are still with us today, embedded in recent federal court rulings that make it easier and easier for more people to carry guns,  as Fordham University historian Saul Cornell and New York University law professor Eric M. Ruben pointed out in The Atlantic in September.

As Cornell and Cohen made clear, “gun-rights advocates find themselves venerating a moment at which slavery, honor, violence, and the public carrying of weapons were intertwined.”

Back in the day, what Dickens, Russell and Bunch understood was a basic truth that seems to have escaped our contemporary legislators and jurists, just as it did those of the slave-holding South. As Russell observed in Mississippi, the government seemed unable and unwilling to rein in gun violence, and the consequences would be inevitable.  “The country in which it is tolerated,” he wrote, “will become as barbarous as a jungle inhabited by wild beasts.”

Day after day, week after week, we see in America the toll taken by gun “rights,” whether the shooters wear beards and veils and murder colleagues in California in some bizarre Bonnie-and-Clyde version of jihad, or shoot people at a Planned Parenthood center in Colorado, or settle scores in Chicago, or slaughter children at a school in Connecticut.

The guns are still with us, and so are the beasts.

“How Texas Teaches History”: Teaching Texas’ Children Without Challenging Conservative Political Views That Are At Odds With History

A Texas high school student and his mother recently called attention to a curious line in a geography textbook: a description of the Atlantic slave trade as bringing “millions of workers” to plantations in the American South. McGraw-Hill Education, the publisher of the textbook, has since acknowledged that the term “workers” was a misnomer.

The company’s chief executive also promised to revise the textbook so that its digital version as well as its next edition would more accurately describe the forced migration and enslavement of Africans. In the meantime, the company is also offering to send stickers to cover the passage.

But it will take more than that to fix the way slavery is taught in Texas textbooks. In 2010, the Texas Board of Education approved a social studies curriculum that promotes capitalism and Republican political philosophies. The curriculum guidelines prompted many concerns, including that new textbooks would downplay slavery as the cause of the Civil War.

This fall, five million public school students in Texas began using the textbooks based on the new guidelines. And some of these books distort history not through word choices but through a tool we often think of as apolitical: grammar.

In September, Bobby Finger of the website Jezebel obtained and published some excerpts from the new books, showing much of what is objectionable about their content. The books play down the horror of slavery and even seem to claim that it had an upside. This upside took the form of a distinctive African-American culture, in which family was central, Christianity provided “hope,” folk tales expressed “joy” and community dances were important social events.

But it is not only the substance of the passages that is a problem. It is also their form. The writers’ decisions about how to construct sentences, about what the subject of the sentence will be, about whether the verb will be active or passive, shape the message that slavery was not all that bad.

I teach freshman writing at Dartmouth College. My colleagues and I consistently try to convey to our students the importance of clear writing. Among the guiding principles of clear writing are these: Whenever possible, use human subjects, not abstract nouns; use active verbs, not passive. We don’t want our students to write, “Torture was used,” because that sentence obscures who was torturing whom.

In the excerpts published by Jezebel, the Texas textbooks employ all the principles of good, strong, clear writing when talking about the “upside” of slavery. But when writing about the brutality of slavery, the writers use all the tricks of obfuscation. You can see all this at play in the following passage from a textbook, published by Houghton Mifflin Harcourt, called Texas United States History:

Some slaves reported that their masters treated them kindly. To protect their investment, some slaveholders provided adequate food and clothing for their slaves. However, severe treatment was very common. Whippings, brandings, and even worse torture were all part of American slavery.

Notice how in the first two sentences, the “slavery wasn’t that bad” sentences, the main subject of each clause is a person: slaves, masters, slaveholders. What those people, especially the slave owners, are doing is clear: They are treating their slaves kindly; they are providing adequate food and clothing. But after those two sentences there is a change, not just in the writers’ outlook on slavery but also in their sentence construction. There are no people in the last two sentences, only nouns. Yes, there is severe treatment, whippings, brandings and torture. And yes, those are all bad things. But where are the slave owners who were actually doing the whipping and branding and torturing? And where are the slaves who were whipped, branded and tortured? They are nowhere to be found in the sentence.

In another passage, slave owners and their institutionalized cruelty are similarly absent: “Families were often broken apart when a family member was sold to another owner.”

Note the use of the passive voice in the verbs “were broken apart” and “was sold.” If the sentence had been written according to the principles of good draftsmanship, it would have looked like this: Slave owners often broke slave families apart by selling a family member to another owner. A bit more powerful, no? Through grammatical manipulation, the textbook authors obscure the role of slave owners in the institution of slavery.

It may appear at first glance that the authors do a better job of focusing on the actions of slaves. After all, there are many sentences in which “slaves” are the subjects, the main characters in their own narrative. But what are the verbs in those sentences? Are the slaves suffering? No, in the sentences that feature slaves as the subject, as the main actors in the sentence, the slaves are contributing their agricultural knowledge to the growing Southern economy; they are singing songs and telling folk tales; they are expressing themselves through art and dance.

There are no sentences, in these excerpts, anyway, in which slaves are doing what slaves actually did: toiling relentlessly, without remuneration or reprieve, constantly subject to confinement, corporal punishment and death.

The textbook publishers were put in a difficult position. They had to teach history to Texas’ children without challenging conservative political views that are at odds with history. In doing so, they made many grammatical choices. Though we don’t always recognize it, grammatical choices can be moral choices, and these publishers made the wrong ones.

“This Is What Erasure Looks Like”: We Are Witness To The Vandalism Of African-American Memory

“This,” says Roni Dean-Burren, “is what erasure looks like.”

She’s talking about something you might otherwise have thought innocuous: a page from World Geography, a high school textbook. A few days ago, you see, Dean-Burren, a former teacher and a doctoral candidate at the University of Houston, was texted a caption from that book by her son Coby, who is 15. It said that the Atlantic slave trade “brought millions of workers from Africa to the southern United States to work on agricultural plantations.” This was in a section called “Patterns of Immigration.”

She says the words jumped out at her. After all, a “worker,” is usually someone who gets paid to do a job. An immigrant is usually someone who chooses to come to a new country. Neither of which describes the millions of kidnapping victims who cleared America’s fields and endured its depravities in lives of unending bondage that afforded them no more rights under the law than a dog or a chair.

As the Trail of Tears was not a nature walk and the Normandy invasion not a day at the beach, black people were neither workers nor immigrants, but slaves. Dean-Burren, who is black, took to social media to explain that. You can guess what happened next. The story went viral, and the embarrassed publisher, McGraw-Hill Education, scrambled to apologize and fix the mess.

That’s all well and good. But let no one think this was incidental or accidental. No, there is purpose here. There is intent. In recent years, we’ve seen Arizona outlaw ethnic studies, Texas teach that slavery was a “side issue” to the Civil War, a Colorado school board require a “positive” spin on American history, and Glenn Beck claim the mantle of the Civil Rights Movement.

We are witness to the vandalism of African-American memory, to acts of radical revision and wholesale theft that strike at the core of black identity. Once your past is gone, who are you? What anchor holds you? So Dean-Burren’s word strikes a powerful chord: This is, indeed, erasure — like a blackboard wiped clean, all the inconvenient pain, sting and challenge of African-American history, gone.

It is, she says, “the saddest thought ever” that her grandchildren might not know Nat Turner’s rebellion or Frederick Douglass’ harsh condemnation of slavery. “The fact that they may not know what it was like for women to get the right to vote, the fact that they may not know that millions of Native Americans were slaughtered at the hands of ‘Pilgrims’ and explorers … I think it says a lot about our society.”

Nor is she persuaded by the argument that teaching the uglier aspects of American history would make students hate their country. She calls that “a crock of poo.” And it is. America’s ugliness defines its beauty as silence defines sound and sorrow defines joy.

“We tell our children that all the time: ‘The reason you’re standing here today … and you have what you have and you can go to the schools you want to go to, and you can say out loud, ‘I want to be an Alvin Ailey dancer …’ or ‘I want to go to Stanford,’ … is that you come from survivors. You come from people who said, ‘I’m going to stick it out. I’m going to make it. I’m going to keep pushing.’ If we don’t know the ugly, I don’t know how you can really love the pretty.”

To put it another way: Black History Matters. So let us be alarmed at attempts to rewrite that history for the moral convenience of others or to preserve what James Baldwin and Ta-Nehisi Coates have described as the fiction of white American “innocence” where crimes of race are concerned. They keep trying to make it less painful, says Dean-Burren, like putting a document through a Xerox machine and making it lighter, lighter and lighter still.

“And then, when you look up, there’s nothing on the page.”

“A Moral Idiot”: Rand Paul Compared Taxation To Slavery And Betrayed The Emptiness Of His Political Philosophy

Rand Paul brought some libertarian philosophy into the Republican presidential primary this week, in the form of the old “taxation is slavery” bumper sticker. He even indexed it to a handy percentage scale! Andrew Kaczynski has the tape: “I’m for paying some taxes. But if we tax you at 100 percent then you’ve got zero percent liberty. If we tax you at 50 percent you are half-slave, half-free.”

Paul is probably getting his argument from Robert Nozick’s Anarchy, State, and Utopia, which famously argued: “Taxation of earnings from labor is on a par with forced labor.” (Note that not even he went so far as to say taxation was literally identical to slavery.) His book was probably the most convincing case that can be made for this stone-cold form of libertarianism, where all “redistributive” policy is morally abhorrent and only the night watchman state is permissible.

Nevertheless, it’s still garbage. Nozick’s book constructs a detailed procedural account of justice, arguing that redistributive taxation is theft because it is a coerced transfer. He was a smart guy, and it’s very hard to get one’s hooks into his argument. The weakness, as with all extremist accounts of property rights, is not with the logic but the premises — particularly when it comes to the very beginning of property.

Go back far enough in history, and there would have been no property of any kind. The moment somebody fences off a piece of land, it necessarily destroys the liberty of everyone else in the world, since they no longer have the right to access that land. Nozick admits this is the case, but still wants to set up initial property rights. So he embraces a concept that he calls the “Lockean proviso.”

This proviso allows appropriation of unowned things, so long as it does not worsen the situation of anyone else. And what about people last in line, so to speak, who can’t appropriate anything because everything is already taken? Well, they will benefit from the general prosperity brought on by market capitalism.

Note what kind of argument this is: It rests on the overall welfare-enhancing consequences of adopting Nozick’s ideas.

The whole point of the “taxation is slavery-ish” argument is that infringing liberty to increase general welfare is morally impermissible. Yet here is Nozick, leaning on a boon to general welfare to justify a violation of liberty so he can get property rights going. This is no different from taxing the rich to provide food stamps, or from the kind of single-payer health insurance system that socialist Bernie Sanders endorses.

The upshot is that the austere libertarianism implied by Paul’s statement is fundamentally unworkable. The horse stumbled right out of the gate, and has to be put down. Neither Milton Friedman nor Friedrich von Hayek went nearly so far. Even Nozick himself apparently abandoned it after a few years.

Let me also comment on Paul’s gruesome tin ear on display here.

What is slavery really? In the U.S. context — and given the reference to Abraham Lincoln’s “House Divided” speech, this is clearly what Paul was getting at — slavery was full property rights in human beings.

It was also incomprehensibly brutal. Owning a person presented a challenge to Southern capitalists, since slave labor has no monetary incentive to work. They solved this problem neatly, with daily violence. Set a steadily increasing daily work quota (pounds of cotton picked, typically), and if it was not achieved, make up the difference with an equal number of stripes with the whip.

In this way, Southern slaves were forced to increase their labor productivity by some 400 percent from 1800 to 1860, achieving a level that was not matched until the development of the mechanical cotton picker. Southern slavery thus robbed both the body and the mind, using systematic torture to force slaves into inventing and spreading techniques of extreme manual dexterity (picking cotton by hand is very difficult).

So if Rand Paul really believes that 1 percent taxation is exactly equal to 1 percent slavery, why doesn’t he sound like an abolitionist? Why not seize one of the federal armories in an attempt to start an all-out war against a monstrous injustice? Indeed, by this measure there would be more slavery today (about 27 percent of GDP taxed) than in in 1860 (1.4 percent taxed, 12.6 percent of the population enslaved).

Only a moral idiot would think to make such an equivalence.
